Forensic Report Exposes Election Fraud In Delta Gubernatorial Election

A forensic report prepared by a team of experts has revealed in detail the fraud perpetrated by the Independent National Electoral Commission of Nigeria and the Peoples Democratic Party during the April 26, 2011 governorship elections in Delta state.

A.    INTRODUCTION, SCOPE AND RESTRICTIONS
1.0    This is a report on the physical inspection and observation of electoral materials used for the April 26, 2011 Delta State Governorship Election carried out pursuant to the May 13 and 24, 2011 orders of the Delta State Governorship Election Tribunal.
2.0    I worked with a team of forensic consultants, accountant, assistants, and technical personnel representing the Democratic Peoples Party (DPP) and carried out the inspection jointly with representatives of the Peoples Democratic (PDP) at INEC State Headquarters in Asaba from June 3 to July 22, 2011. Officials of INEC and government security agencies were present throughout the exercise.
3.0    The report is in respect of Polling Units where results declared by INEC are in dispute in the whole of Warri North, Burutu, Bomadi and parts of Warri South, Ethiope West and Warri South West Local Government Areas.
4.0    The report is based on material facts available to me up to the time of filing. In the event that new material information that could impact on the findings is made available to me, I reserve the right to review the findings set out here.
B.    METHODOLOGY
1.0    The method adopted involved 100% physical inspection and observation of electoral materials produced by INEC. Copies of inspected ballot papers were taken using a digital scanners and computers for further detailed inspection.
C.    INFORMATION RELIED UPON
1.0.    This report is based on and guided by the following electoral materials:

2.0.    Ballot papers (Item C. 1.0. a.) were produced for inspection between June 3 and July 22, 2011 at INEC Office in Asaba. Original copies of items C. 1.0. (b., and c.) were given to my team on request.
3.0.    Copies of items C. 1.0. (d., e., f., g. and h.) above were given to my team on August 27, 2011 while copies of items C. 1.0. (i., j. and k.) above were given to my team on May 20, 2011.
D.    FINDINGS
1.0.    WARRI NORTH LOCAL GOVERNMENT AREA
1.1.    The physical inspection and observation of electoral materials in Warri North was in respect of all 119 Polling Units in the Local Government Area, where results declared by INEC are in dispute.
1.2.    INEC codes for the 119 Polling Units, serial numbers of Forms EC 8A and the total votes of 61,124 recorded for these Polling Units are shown in Appendix WN1. The 61,124 votes are part of votes collated on Forms EC 8B (with Serial Numbers 00846 3501, 00846 3513, 00846 3512, 00846 3511, 00846 3510, 00846 3509, 00846 3508, 00846 3507, 00846 3506 and 00846 3504) and Form EC 8C (with Serial Number 01160 1150).
1.3.    BALLOT PAPERS
1.31.    60,073 ballot papers were presented by INEC for inspection, instead of 61,124 ballots, leaving a shortfall of 1,051, though 61,124 votes were entered in Forms EC 8A in dispute. See Appendix WN2.
1.32.    The following were observed on the 60,073 ballot papers inspected:
a.    All 60,073 ballot papers did not relate to any Form EC 40A.
b.    2,148 ballot papers do not relate to Form EC 25B. See Appendix WN3.
c.    799 ballot papers (Polling Unit 001, Ward 02) were dated 25/04/11.
d.    401 ballot papers (Polling Unit 016, Ward 03) are dated “26/11”.
e.    852 ballot papers were not signed.
f.    10,739 ballot papers were not dated. 
g.    339 ballot papers were not stamped.
h.    273 ballot papers were not detached from their counterfoils.
i.    81 .ballot papers were blank – not with any thumbprint.
1.40.    FORM EC 25B
1.41.    Forms EC 25B were produced for 115 Polling Units, instead of 119 units.
1.42.    4 Polling Units (with 2,148 votes generated) had no Forms EC 25B. See Appendix WN3.
1.43.    The following observations were noticed on the 115 Forms EC 25B produced:
a.    99 showed no SERIAL NUMBERS of ballot papers received.  A total of 51,024 votes were generated from these units. See Appendix WN4.
b.    66 showed no QUANTITIES of ballot papers received. A total of 34,390 votes were generated from these units. See Appendix WN5.
c.    48 did not show receipt of VOTERS REGISTERS. A total of 26,080 votes were generated from these units. See Appendix WN6.
d.    108 did not show cognizable HUMAN NAMES and ADDRESSES of persons issuing electoral materials, though this was required. A total of 54,387 votes are generated from these units. See Appendix WN7.
e.    None showed receipt of Form EC 60E. A total of 58,980 votes were generated from these units. See Appendix WN8.
1.50.    FORMS EC 40A, EC 40C AND EC 17
a.    All the 119 Polling Units in Warri North (with 61,124 votes) did not show receipt/utilisation of Forms EC 40A and 40C.
b.    No Form EC 17 endorsed by any Polling Unit Presiding Officer was produced.
1.60.    No Form EC 8A in the 119 Polling Units is supported or supportable with ballot papers received on Form EC 25B and accounted for and verified on Form EC 40A.
2.0.    WARRI SOUTH LOCAL GOVERNMENT AREA
2.1.    The physical inspection and observation of electoral materials in Warri South Local Government Area was in respect of 116 Polling Units, where results declared by INEC are in dispute.
2.2.    INEC codes for the 116 Polling Units, serial numbers of Forms EC 8A and the total votes of 69,067 recorded for these Polling Units are shown in Appendix WS1. The 69,067 votes are part of the votes collated on Forms EC 8B (with Serial Numbers 00846 7254, 00846 7263, 00846 7245, 00846 7246, 00846 7247, 00846 7248, 00846 7249, 00846 7250, 00846 7251 and 00846 7252) and Form EC 8C (with Serial Number 01160 1151).
2.3.    BALLOT PAPERS
2.31.    64,161 ballot papers (of which 5,130 were not traceable to polling units) were presented by INEC for inspection, instead of 69,067 ballot papers. This leaves a shortfall of 4,906 ballot papers, although 69,067 votes were entered in Forms EC 8A. This means that only 59,031 ballot papers were referred to polling units in envelopes labelled with the names or INEC codes of the units. See Appendix WS2.
2.32.    The following were observed on the 59,031 ballot papers traced to units, using unit codes handwritten on their envelopes:
a.    All 59,031ballot papers could not be related to any Form EC 40A.
b.    52,822 ballot papers could not be related to Form EC 25B. See Appendix WS3.
c.    1,158 ballot papers were not signed;
d.    753 ballot papers were not stamped;
e.    5,895 ballot papers were not dated;
f.    2,520 ballot papers were not detached from their counterfoils;
g.    793 ballot papers were dated “26/11”.
2.33.    The 5,130 ballot papers in unlabelled envelopes and not traceable to Polling Units are not related to any Form EC 25B or EC 40A.
2.40.    FORM EC 25B
2.41.    Forms EC 25B were produced for 30 Polling Units (with 16,245 votes generated) instead of 116 units.
2.42.    86 Polling Units (with 52,822 votes generated) had no Forms EC 25B. See Appendix WS3.
2.43.    The following observations were noticed on the 30 Forms EC 25B produced:
a.    28 showed no SERIAL NUMBERS of ballot papers received. A total of 15,645 votes were generated from these units. See Appendix WS4.
b.    None showed the QUANTITIES of ballot papers received, SERIAL of Forms EC 8A NUMBERS received and NAMES and ADDRESS of person issuing electoral materials. A total of 16,245 votes were generated from these units. See Appendix WS5.
c.    15 did not show receipt of VOTERS REGISTERS. A total of 8,148 votes were generated from these units. See Appendix WS6.
d.    10 showed no receipt of BALLOT BOXES.  A total of 5,441 votes were generated from these units. See Appendix WS7.
e.    27 showed no receipt of Form EC 60E. A total of 13,796 votes were generated from these units. See Appendix WS8.
2.50.    FORMS EC 40A, EC 40C AND EC 17
a.    All the 116 Polling Units (with a total of 69,067 votes) did not show receipt/utilisation of Forms EC 40A and 40C.
b.    No Form EC 17 endorsed by any Polling Unit Presiding Officer was produced.
2.60.    No Form EC 8A in the 116 Polling Units is supported or supportable with ballot papers received on Form EC 25B and accounted for and verified on Form EC 40A.
3.0.    ETHIOPE WEST LOCAL GOVERNMENT AREA
3.1.    The physical inspection and observation of electoral materials in Ethiope West Local Government Area was in respect of 108 Polling Units, where results declared by INEC are in dispute.
3.2.    INEC codes for the 108 Polling Units, serial numbers of Forms EC 8A and the total votes of 48,910 recorded for these Polling Units are shown in Appendix EW1. The 48,910 votes are part of votes collated on Forms EC 8B (with Serial Numbers 00846 5580, 00846 7581, 00846 7198, 00846 7572, 00846 7579, 00846 7578, 00846 7577, 00846 7575, and 00846 7576) and Form EC 8C (with Serial Number 01160 1166) for Ethiope West.
3.3.    BALLOT PAPERS
3.31.    48,193 ballot papers (of which 6,127 were not traced to polling units) were presented by INEC for inspection, instead of 48,910 ballot papers. This leaves a shortfall of 717, although 48,910 votes were entered in Forms EC 8A in dispute. This means that only 42,066 ballot papers were referred to polling units in envelopes labelled with the names or INEC codes of the units. See Appendix EW2.
3.32.    The following observations were noticed on the 42,066 ballot papers traced to units, using unit codes handwritten on their envelopes:
a.    38,952 ballot papers could not be related to any Form EC 40A. See Appendix EW8.
b.    3,995 ballot papers could not be related to any Form EC 25B. See Appendix EW3.
c.    1,449 ballot papers are not signed;
d.    1,546 ballot papers are not stamped;
e.    4,992 ballot papers are not dated.
3.33.    The 6,127 ballot papers not traceable to Polling Units are not related to any Form EC 25B or EC 40A
3.40.    FORM EC 25B
3.41.    99 Forms EC 25B were produced for 99 Polling Units (where results are in dispute) instead of 108 units.
3.42.    9 Polling Units (with 3,995 votes generated) had no Forms EC 25B. See Appendix EW3.
3.43.    The following observations were noticed on the 99 Forms EC 25B produced:
a.    None showed the SERIAL NUMBERS of ballot papers received and cognisable human NAMES and ADDRESSES of persons issuing electoral materials. A total of 44,906 votes were generated from these units. See Appendix EW4.
b.    58 showed no QUANTITIES of ballot papers received. A total of 24,337 votes were generated for these Polling Units. See Appendix EW5.
c.    46 did not show receipt of VOTERS REGISTERS. A total of 18,113 votes were generated in those units. See Appendix EW6.
d.    79 did not show receipt of Form EC 60E. A total of 37,392 votes were generated from these units. See Appendix EW7.
3.50.    FORMS EC 40A, EC 40C AND EC 17
a.    18 Forms EC 40A were produced by INEC, instead of 108.
b.    90 Forms EC 40A were not produced for 90 Polling Units. A total of 38,952 votes were generated in those units. See Appendix EW8.
c.    14 “Forms EC 40C” titled “Ballot Paper Account and Verification Statement” were produced by INEC.
d.    No Form EC 40C (Statement of Unused and Spoilt Ballot Papers) showing quantities/serial numbers of unused and spoilt ballot papers was produced by INEC.
e.    No Form EC 17 endorsed by any Polling Unit Presiding Officer was produced.
4.0.    BURUTU LOCAL GOVERNMENT AREA
4.1.    The physical inspection and observation of electoral materials was in respect of all 219 Polling Units in Burutu Local Government Area.
4.2.    INEC codes for the 219 Polling Units, serial numbers of Forms EC 8A and the total votes of 48,125 (including 1,110 excess votes entered in Form EC 8C) recorded in Burutu Local Government Area are shown in Appendix BU1a and Appendix BU1b. The 48,125 votes are collated on Forms EC 8B (with Serial Numbers 00846 1791, 00846 1792, 00846 1789, 00846 1790, 00846 1788, 00846 1787, 00846 1786, 00846 1785, 00846 1784 and 00846 8155 & 7877) and cccv Form EC 8C (with Serial Number 01160 1164).
4.3.    BALLOT PAPERS
4.31.    35,665 ballot papers (of which 16,132 were not traceable to polling units) were presented by INEC for inspection, instead of 48,125 ballot papers. This leaves a shortfall of 12,460, 48,125 votes were entered in Forms EC 8A dispute. This means that only 19,533 were referred to polling units in envelopes labelled with the names or INEC codes of the units. See Appendix BU2.
4.32.    The 16,132 ballot papers not traced to Polling Units are not related to Forms EC 25B or EC 40A.
4.33.    The following were observed on the 19,533 ballot papers traced to 59 units, using unit codes handwritten on their envelopes:
a.    All 19,533 could not be related to any Form EC 40A.
b.    1,146 are not signed.
c.    183 are not stamped.
d.    7,225 are not dated.
e.    535 ballot papers were not detached from their counterfoils.
4.40.    FORM EC 25B
4.41.    Forms EC 25B were produced for 179 Polling Units instead of 219 units. See Appendix BU3a.
4.42.    40 Polling Units (with 664 votes recorded) had no Forms EC 25B. See Appendix BU3b.
4.43.    The following observations were noticed on the 179 Forms EC 25B produced:
a.    29 did not show receipt of VOTERS REGISTERS. A total of 7,605 votes were generated from these units. See Appendix BU4.
b.    All 179 showed no QUANTITY or SERIAL NUMBERS of ballot papers received and the NAMES and ADDRESSES of persons issuing electoral materials. A total of 46,351 votes were generated from these units. See Appendix BU3a.
c.    170 did not show receipt of Form EC 60E. A total of 45,889 votes were generated from these units. See Appendix BU5.
4.50.    FORMS EC 40A, EC 40C AND EC 17
a.    All the 179 Polling Units (with a total 48,125 votes, including 1,110 votes not traceable to any unit) did not show receipt/utilisation of Forms EC 40A and 40C.
b.    No Form EC 17 endorsed by any Polling Unit Presiding Officer was produced
4.60.    No Form EC 8A in from any Polling Units is supported or supportable with ballot papers received on Form EC 25B and accounted for and verified on Forms EC 40A.
5.0.    BOMADI LOCAL GOVERNMENT AREA
5.1.    Physical inspection and observation of electoral materials in Bomadi Local Government Area was in respect of all 93 Polling Units, where results declared by INEC are in dispute.
5.2.    INEC codes for the 93 Polling Units, serial numbers of Forms EC 8A and the total votes of 57,141 recorded on them are shown in Appendix BO1. The 57,141 votes are collated on Forms EC 8B (Serial Numbers 00846 7161, 00846 7160, 00846 7157, 00846 7156, 00846 7155, 00846 7158, 00846 7159, 00846 7152, 00846 7163 and 00846 7152) and Form EC 8C (Serial Number 01160 1163).
5.3.    BALLOT PAPERS
5.31.    33,239 ballot papers (of which 29,512 were in unlabelled envelopes and could not be traced to polling units) were presented by INEC for inspection, instead of 57,141 ballot papers. This leaves a shortfall of 23,902, though 57,141 votes are entered in Forms EC 8A in dispute. This means that only 3,727 ballot papers were traced to units, using unit codes handwritten on envelopes. See Appendix BO2.
5.32.    The 29,512 ballot papers not traceable or referable to Polling Units are not related to Forms EC 25B or EC 40A.
5.33.    The 3,727 ballot papers traced to units (using unit codes handwritten on their envelopes) were for the 7 Polling Units in Appendix BO2.
5.40.    FORM EC 25B
5.41.    Forms EC 25B were produced for 71 Polling Units instead of 93 units.
5.42.    22 Polling Units had no Forms EC 25B. A total of 9,670 votes were generated from these units. See Appendix BO3.
5.43.    The following observations were noticed on the 71 Forms EC 25B produced:
a.    14 showed no QUANTITIES OF BALLOT papers received. A total of 8,132 votes were generated from these units. See Appendix BO4.
b.    All 71 showed no SERIAL NUMBERS of ballot papers received; no SERIAL NUMBERS of Forms EC 8A received and no cognisable human NAMES and ADDRESS of persons issuing electoral materials. A total of 47,532 votes were generated from these units. See Appendix BO5.
c.    57 did not show receipt of VOTERS REGISTERS. A total of 38,554 votes were generated from these units. See Appendix BO6.
d.    52 did not show receipt of Form 60E (Notice of Result of Poll Poster). A total of 34,999 votes were generated from these units. See Appendix BO7.
e.    Form EC 25B relating to Polling Unit 008, Ward 04 is blank. A total of 1,194 votes were generated from this unit.
5.50.    FORMS EC 40A, EC 40C AND EC 17
a.    All the 93 Polling Units (with a total of 57,141 votes) did not show receipt/utilisation of Forms EC 40A and 40C.
b.    No Form EC 17 endorsed by any Polling Unit Presiding Officer was produced.
5.60.    No Form EC 8A in the 93 Polling Units is supported or supportable with ballot papers received on Form EC 25B and accounted for and verified on Forms EC 40A.
6.0.    WARRI SOUTH-WEST LOCAL GOVERNMENT AREA
6.1.    Physical inspection and observation of electoral materials in Warri South-West Local Government Area was done in respect of 165 Polling Units, where results declared by INEC are in dispute.
6.2.    INEC codes for the 165 Polling Units, serial numbers of Forms EC 8A and the total votes of 54,591 recorded for the Polling Units are shown in Appendix WSW1. The 54,591 votes are collated on Forms EC 8B (with Serial Numbers 00846 3501, 00846 3503, 00846 7255, 00846 3514, 00846 3515, 00846 3516, 00846 7256, 00846 3517, 00846 3520, 00846 3533 and 00846 3523) and Form EC 8C (with Serial Number 01160 1152).
6.3.    BALLOT PAPERS
6.31.    51,354 ballot papers (of which 7,743 could not be traced to polling units) were presented by INEC for inspection, instead of 54,591 ballot papers. This leaves a shortfall of 3,237 ballot papers, although 54,591 votes were entered in Forms EC 8A for units where results are in dispute. This means that only 43,611 could be traced to units. See Appendix WSW2.
6.32.    The 7,203 ballot papers not traceable to Polling Units are not related to Forms EC 25B or EC 40A.
6.33.    The following were observed on the 43,611 ballot papers traced to 129 (out of 165) Polling Units, using unit codes handwritten on their envelopes:
a.    42,197 ballot papers could not be related to Forms EC 40A. See Appendix WSW10.
b.    560 ballot papers were not signed.
c.    10,974 ballot papers were not dated.
     
d.    34 ballot papers were not stamped.
e.    248 ballot papers were not detached from their counterfoils.
6.40.    FORM EC 25B
6.41.    81 Forms EC 25B were produced (for 81 Polling Units) instead of 165 (for 165units). All 81 units are listed in Appendix WSW4.
6.42.    84 Forms EC 25B were not produced for 84 Polling Units. A total of 32,246 votes were generated from these units. See Appendix WSW3.
6.43.    The following observations were noticed on the 81 Forms EC 25B produced:
f.    All 81 showed no SERIAL NUMBERS of ballot papers received and cognisable human NAMES and ADDRESSES of persons issuing electoral materials. A total of 22,345 votes were generated from these units. See Appendix WSW4.
g.    69 showed no QUANTITIES OF BALLOT PAPERS received. A total of 19,837 votes were generated from these units. See Appendix WSW5.
h.    48 showed no receipt of VOTERS REGISTERS. A total of 12,916 votes were generated from these units. See Appendix WSW6.
i.    19 showed no receipt of BALLOT BOXES. A total of 5,529 votes were generated from these units. See Appendix WSW7.
j.    9 showed no receipt of BALLOT PAPERS. A total of 3,049 votes were generated from these units. See Appendix WSW8.
k.    77 showed no receipt of Form EC 60E (Notice of Result of Poll Poster). A total of 21,133 votes were generated from these units. See Appendix WSW9.
6.50.    FORMS EC 40A, EC 40C AND EC 17
a.    32 Forms EC 40A were produced (for 32 Polling Units) instead of 165, leaving a shortfall of 133.
b.    133 Polling Units without Forms EC 40A are listed in Appendix WSW10. A total of 42,197 votes were generated from these units.
c.    10 (of the 32 Forms EC 40A) showed no Serial Numbers of ballot papers received for Polling Units 003, 004, 008, 009, 026, 033, 034, 035, 038 and 044, all in Ward 08.
d.    18 “Forms EC 40C” titled “Ballot Paper Account and Verification Statement” were produced by INEC.
e.    No Form EC 40C (Statement of Unused and Spoilt Ballot Papers) was produced by INEC.
f.    No Form EC 17 endorsed by any Polling Unit Presiding Officer was produced.
E.    SUMMARY
1.0    ELECTORAL FORMS
1.1.    A summary of the non-production of Forms EC 40A, EC 25B and EC 60E by INEC, non-receipt of critical electoral materials on Forms EC 25B and the non-disclosure of necessary audit trail information of serialised electoral materials (Ballot Papers, Forms EC 8A) on Forms EC 25B is as follows and clearly captured in Table I:
a.    NON-PRODUCTION OF FORMS EC 40A
There are no Forms EC 40A (Ballot Paper Account and Verification Statement) to confirm that a total of 316,606 ballots papers were RECEIVED/CERTIFIED USED by Presiding Officers in 730 (out of 820) Polling Units where results declared by INEC are in dispute across the 6 Local Government Areas. Without Form EC 40A, a critical accounting and audit document in the electoral process, election could not have been duly conducted in these units, with a total of 316,606 votes.
b.    NON-PRODUCTION OF FORMS EC 25B
There are no Forms EC 25B (Electoral Material Receipts) to confirm that 101,545 ballot papers and other electoral materials were received in 245 Polling Units across the 6 Local Government Areas. Without Forms EC 25B, election could not have been conducted in these units with a total of 101,545 votes.
c.    NON-RECEIPT OF VOTERS REGISTERS
From Forms EC 25B produced, voters registers were not received in 243 Polling Units across the 6 Local Government Areas. Without Voters Registers, election could not have been conducted in these units with a total of 111,416 votes.
d.    NON-DISCLOSURE OF SERIAL NUMBERS OF BALLOT PAPERS
Serial numbers of ballot papers are not disclosed on Forms EC 25B produced for 486 Polling Units across the 6 Local Government Areas. Without the serial numbers, ballot papers inspected could not be confirmed for these units, with a total of 227, 803 votes.
e.    NON-DISCLOSURE OF QUANTITIES OF BALLOT PAPERS
Quantities of ballot papers are not disclosed on Forms EC 25B produced for 416 Polling Units across the 6 Local Government Areas. Without the quantities, ballot papers inspected could not be confirmed for these units, with a total of 149, 292 votes.
f.    NON-DISCLOSURE OF NAMES AND ADDRESSES OF PERSONS ISSUING ELECTORAL MATERIALS
The names and addresses of persons issuing electoral materials are not disclosed on Forms EC 25B produced for 568 Polling Units across the 6 Local Government Areas. Without the identities and addresses of these persons, it could not be verified whether authorised INEC personnel issued electoral materials to these units, with a total of 232,043 votes.
g.    NON-RECEIPT OF FORM EC 60E
From Forms EC 25B produced, Forms EC 60E (Notice of Result of Poll Posters) were not received in 520 Polling Units across the 6 Local Government Areas. Without Forms EC 60E, results of election could not have been publicly published at these units, with a total of 212,189 votes.
